These General Terms and Conditions ("General Terms") apply to you when you place an order as a consumer customer ("you", "customer") through the website operated by Hand Finnished ("we", "Hand Finnished") www.handfinnished.fi, www.handfinnished.com or other related websites ("Online Store"). We encourage you to read these general terms and conditions carefully before placing an order in the online store.

In order to place an order in the online store, the customer must be at least 18 years old and have a permanent delivery address in the delivery area of the online store. Permanent addresses are not considered to be, for example, PO box addresses, hotels or other similar temporary addresses.

The customer must accept these general terms and conditions in order to place an order in the online store. By accepting the general terms and conditions, the customer agrees to comply with the general terms and conditions in their entirety and at the same time expressly accepts the use of their personal data and cookies in accordance with Hand Finnished's data protection and cookie policy.

Ordering products and forming a contract

Products are ordered from the online store by adding the products to the shopping cart and making the payment on the online store's "Shopping Cart" page. We encourage you to carefully review your order separately on each page displayed during the ordering process. Ordering from the online store requires providing a valid email address. The agreement is made when Hand Finnished confirms the order by email. The information presented in the Hand Finnished online store or in any other advertising, brochures and other written communication is for information purposes only and does not constitute an offer to deliver any products by Hand Finnished. The confirmation will include the price of the order, shipping costs and products ordered, as well as any other information required by applicable law.

 

Prices, costs and taxes

The prices are valid until further notice. All prices include VAT. For orders where the delivery address is outside of the EU, VAT will be excluded from the total order sum. 

The prices quoted only apply to orders placed in this online store. The formation of delivery costs is described in the section "Delivery method and Delivery costs" of these general terms and conditions. Shipping costs per order are shown in the shopping cart. Hand Finnished reserves the right to make changes to prices and delivery costs, however, in such a way that any changes in price and delivery costs only apply to orders made after the changes have entered into force.

 

Payment methods

You can pay for your purchases in the online store using the specified methods. Unless otherwise agreed, Hand Finnish has the right to charge you in connection with the order. Hand Finnished reserves the right not to offer all payment methods at all times or alternatively to suggest a change of payment method if for some reason the payment method you have chosen does not work when fulfilling the order.

The payment service provider and payment service provider is Paytrail Oyj (2122839-7) in cooperation with Finnish banks and credit institutions. Paytrail Oyj is shown as the recipient of the payment on the bank statement or card invoice and forwards the payment to the merchant. Paytrail Oyj is licensed as a payment institution. In the event of a complaint, please contact the supplier of the product in the first instance.

Shipping method and shipping costs 

Delivery options for products are given in the online store at checkout, depending on the country you are ordering from and the weight of your order. If your order total is €150 or more and the delivery address is in Finland, certain shipping options are free (this may change during promotions). Free delivery does not apply to home delivery or orders sent to delivery addresses outside of Finland.

Letter delivery is given as an option at the checkout if the product is suitable to be sent as a letter. This has been calculated for each product in the online store, and the price of a letter item suitable for the weight of the product is given at checkout. Of these smallest mailing options, Posti's letter with a tracking code is delivered to the recipient's mailbox, and Matkahuolto's xxs parcel is delivered to a Matkahuolto parcel locker.

Our online store only delivers orders to mainland Finland and other countries listed at the checkout. We do not deliver orders to the Åland Islands.

There is no exchange option in our online store. If you want to exchange a product you have ordered, you must return the product to our store and place a completely new order for the desired product.

Refund: We will refund your returned items in accordance with your payment method as soon as possible after we have received and processed your return. You will receive a notification of the refund by email. We will refund the part paid with the gift card to you with a new gift card.

The shipping costs of products purchased from the online store include postage and packaging costs. Hand Finnished will send you the tracking number of the package by email when the products are shipped. Please note that the risk liability, meaning that the risk e.g. damage or loss of the product will pass to you once the product has been delivered to you. If the packaging appears to be damaged, we advise you not to accept delivery.

 

Delivery time 

The estimated delivery time for products that are already in stock is three business days. The estimated delivery time for knitted products that are not already in stock is 2-4 weeks. As a rule, a product is put into production when the customer has placed an order and paid either through a payment service or by bank transfer, but the most popular products are usually in stock in small quantities. The delivery time of a custom-made product is usually longer than that of a product in the online store's selection, depending on the necessary design work and material purchases. During special promotions and during the peak season (orders placed in September-December), the delivery time may be extended from the normal delivery time due to high demand, but very rarely by more than two weeks.

If you have ordered more than one product, the order will be shipped when all the products included in the order are ready to be shipped. The products can be sent in several batches upon request, in which case the customer pays for the postage of the additional shipment.

 

Limitation of Liability

Unless otherwise provided by applicable mandatory legislation, Hand Finnished shall not be liable for any direct or indirect damage, unless it is caused by intentional or grossly negligent actions or omissions on the part of Hand Finnished.

 

Right of withdrawal 

The products have a 30-day right of return/cancellation from the receipt of the order. In addition, we offer an extended return policy for products purchased as Christmas gifts until 7 January. Returns/cancellations must always be agreed upon in advance. Intentional failure to pick up an order will not be considered a return of the order and in these cases the order will not be refunded. In the cancellation notice, you must indicate your name, address, phone number, order date, product and reason for return. The cancellation notice must be sent by email to: sales@handfinnished.fi. The product must be returned by post within 14 days of the cancellation notice. The products must be in their original packaging, unused, intact and fit for sale, and they must have product codes and tags in place.

Return costs are the responsibility of the customer. For returns of defective or incorrectly shipped items, the supplier is responsible for the return shipping costs. The product must be returned as a shipment with a tracking code.

If the product has been used, we reserve the right to charge for the depreciation.

In all cases, Hand Finnished's liability is limited to the selling price of the ordered products.

Exceptions to the right of return/cancellation

THE RIGHT OF RETURN DOES NOT APPLY TO CUSTOM-MADE PRODUCTS (Consumer Protection Act, Section 16)

Custom-made products are subject to the terms and conditions of custom-made products in accordance with Chapter 6, Section 16 of the Consumer Protection Act, i.e. they do not have a separate right of return. Custom-made products are all products that have been made either according to special requests or modified from products sold in the online store at the customer's request.

The right of return also does not apply when the custom-made work has already begun, even though it has not yet reached the customer.

It is not possible to cancel an order for a custom-made product, so please make your purchase decision bindingly.

We are fully responsible for the quality of the product and if there is a clear defect in a made-to-order product, we will correct the defect or, if repair is not possible, we will refund an appropriate portion of the order price.

When the customer cancels an order made in the online store, and unless otherwise agreed, Hand Finnished will refund the payment made for this, including delivery costs, using the payment method used by the customer in the original purchase transaction. The refund does not cover any additional costs caused by the customer's choice other than the standard delivery offered by Hand Finnished. If only part of the order is returned, the shipping costs will not be refunded. If the customer has received free shipping when purchasing three or more products in connection with the order, and after the return there are less than three products left in the order that the customer decides to keep, 6.90€ will be deducted from the return amount as postage. The customer is responsible for the impairment of the product that has been taken into use, and Hand Finnished deducts from the amount to be refunded an amount that corresponds to the impairment of the product compared to the original value of the product. 

If the product has become unfit for sale as a result of its use, the customer is responsible for the full value of the product and, if the customer wants the product to be sent again, for the shipping costs incurred as a result.

If a product purchased from the online store has been returned to Hand Finnished's return address as described above, Hand Finnished, in cooperation with the payment service provider, will return the amount paid by the customer to the customer without undue delay, but no later than fourteen (14) days from the date on which Hand Finnished received the customer's cancellation notice. However, Hand Finnished may postpone the refund until Hand Finnished has received the product.

Return costs are the responsibility of the customer. For returns of defective or incorrectly shipped items, the supplier is responsible for the return shipping costs.

If you wish to return or exchange items after the returns period has ended, please contact us directly. When returning a delivered order, please include your name and contact information as well as your bank account number for a refund. We will refund the amount you have paid in full within 14 days of receiving the cancellation notice, if the product has been returned or it has been verifiably delivered to the return address by post:

When returning a parcel to a post office, the customer must make sure that they receive a return receipt. The item cannot be returned to a letterbox.

 

Custom-made products

If a new design is designed at the customer's request, Hand Finnished reserves the right to use this design in part or in full for other products as well. An exception to this is a photo taken by the customer and sent to Hand Finnished. If the knitting pattern has been made  from a picture sent by the customer so that the resemblance to the image is indisputable, this pattern will not be used in other products without the customer's consent.

 

Product defects

If the customer discovers that a product purchased from the online store has a defect in accordance with the applicable consumer protection legislation, the customer may make a complaint to Hand Finnished in this regard. Complaints must be made as soon as possible after the defect has been detected, using the contact information provided in the online store. If any defect(s) are detected, they must be reported in connection with the same and the first complaint. Additional complaints will not be accepted or taken into account unless it is a question of incorrect correction of a defect complained of the first time.

If the complaint leads to the return of the product, Hand Finnished will be responsible for the resulting transport costs.

Once the product that was the subject of the complaint has been returned and the complaint has been found to be justified, Hand Finnished will pay the customer a refund in accordance with the applicable consumer protection legislation. Hand Finnished will endeavour to make the payment within thirty (30) days from the date on which Hand Finnished has received the product that is the subject of the complaint, but the processing of the complaint may be delayed depending on the nature of the product. If the product returned as a result of the complaint is not defective in accordance with the applicable consumer protection legislation, Hand Finnished may reject the complaint and the customer may then be charged the transport costs incurred by the customer for returning the product.

These General Terms and Conditions do not limit the customer's rights under applicable consumer protection legislation or the trader's statutory liability for defects in product defects, including the right to demand the repair of the defect or the replacement of the product with a new one.

Due to the flexible properties of the material used, the dimensions of the knitted products are not absolute, and the dimensions given in the product description or when placing the order are indicative. Small variations do not count as a product defect. Hand Finnished is not responsible for the availability of products sold in the online store at all times, nor for image or printing errors, incorrect prices or price adjustments (such as prices and currency changes by suppliers) in the online store. If an incorrect price has been indicated for the product ordered by the customer, Hand Finnished will notify the customer of this and wait for the customer's approval of the corrected price before continuing the order process. Hand Finnished is not responsible for any information provided by third parties for the purpose of the online store.

 

Linking

Hand Finnished may provide links to other websites that are not under the control of Hand Finnished. Websites that are not under the control of Hand Finnished may also provide links to the online store. Although Hand Finnished strives to ensure that Hand Finnished only provides links to websites that comply with personal data and security regulations corresponding to Hand Finnished's Privacy Policy, Hand Finnished is not responsible for the security or confidentiality of any information or personal data provided by the customer on third-party websites. The customer must exercise due caution and should read the provisions regarding personal data that are complied with on the website in question.

 

Force majeure

Subject to applicable mandatory law, Hand Finnished shall not be liable for any delays or damages caused by circumstances beyond the control of Hand Finnished. These include, for example; general industrial action, hostilities, fires, lightning, terrorist attacks, changes in official regulations, technical problems, failures in power/telecommunications/computer connections or other communications, as well as failures and delays in the provision of services by subcontractors due to the above circumstances. If such a situation arises, Hand Finnished will notify the customer of it both at the beginning and at the end of the situation. If the situation has lasted for more than two (2) months, both the customer and Hand Finnish have the right to interrupt the purchase transaction made in the online store with immediate consequences.

 

Changes to the General Terms and Conditions

Hand Finnished reserves the right to change these general terms and conditions at any time. Any changes to these General Terms and Conditions will be published in the Online Store. The changes will enter into force when the customer has accepted the general terms and conditions (in connection with a new purchase or when browsing the online store) and in any case thirty (30) days after Hand Finnished has published the changes. Hand Finnished recommends that the customer visits the online store regularly to be informed of changes to the general terms and conditions.

 

Partial invalidity

If any provision of this Agreement is found by any court, authority or arbitral tribunal to be invalid or unenforceable, the remainder of that provision and all other provisions shall remain in full force and effect to the fullest extent permitted by applicable law. Any provision found to be invalid or unenforceable shall be replaced by equivalent valid and enforceable provisions.

 

Applicable Law and Dispute Resolution

As a rule, all disputes arising from these general terms and conditions or from the online store and purchases made therein shall be resolved by agreeing with Hand Finnished's customer service (contact information in section 2) and finally in a court determined in accordance with the mandatory legal provisions of the place of jurisdiction. In the event of a dispute, Hand Finnished strives to comply with the decisions of the Finnish National Consumer Complaints Board or similar authorities in other European countries.

These General Terms and Conditions shall be governed by the laws of the country resulting from mandatory legislation. Unless otherwise provided by applicable mandatory legislation, these General Terms and Conditions shall be governed by Finnish law and any disputes arising from these General Terms and Conditions shall be finally resolved by the courts of Finland.
